Terms And Conditions (T&C) The General Terms and Conditions of Mapli.ch
Mapli.ch™ – SwissYear Plus™
Version: 1.0
Date: August 2026
1. Provider and Scope
Mapli.ch™ is an offering of SwissYear Plus™.
Provider: SwissYear
Picassoplatz 4
4052 Basel
Switzerland
Mapli.ch™ provides a digital discovery, classification and navigation infrastructure for places, institutions, activities, services, events, commercial offerings and digital content in Switzerland.
Mapli.ch™ is in particular:
- a map-based discovery platform;
- a structured classification and curation system;
- a platform for selective visibility of listings;
- a navigation and orientation layer;
- an infrastructure connecting places, offerings and experiences.
Mapli.ch™ is not, in particular:
- a travel agency;
- a tour operator;
- a provider of package holidays;
- a provider of bundled travel services;
- a logistics or travel accompaniment service;
- a complete or mandatory industry or location directory.
Mapli.ch™ follows an explicitly curated approach and does not claim to represent every existing business, place, service or offering.
2. Scope of Application
These Terms and Conditions apply to the use of Mapli.ch™ and to all services made available through Mapli.ch™.
They apply in particular to:
- registered users;
- advertisers and listing owners;
- content and media partners;
- purchasers of digital products;
- users of booking, ticketing or contact functions.
Specific terms applicable to individual products, listings, bookings, digital content or services take precedence over these Terms where expressly applicable.
Deviating terms of business customers shall only apply where SwissYear has expressly agreed to them in writing.
3. Contracting Party and Formation of Contract
Depending on the nature of the use, different contractual relationships may arise between SwissYear and a user or provider.
A contract may be formed through:
- registration of a user account;
- ordering a paid product;
- booking or purchasing an individual service offered through Mapli.ch™;
- concluding a listing, visibility or advertising agreement;
- acceptance of an individual offer;
- placing an order;
- using an expressly chargeable function.
The mere use of freely accessible discovery functions does not generally create a paid contractual relationship.
SwissYear may reject requests, listings, registrations or offers where no mandatory legal provision prevents such rejection.
4. Free Use
The basic discovery functions of Mapli.ch™ may be provided free of charge.
These may include:
- map views;
- regional exploration;
- category navigation;
- basic listings;
- public entity pages;
- general search and discovery functions.
SwissYear may develop, restrict or discontinue the scope, availability or technical implementation of free functions.
There is no entitlement to the permanent availability of any particular free function.
5. Listings and Platform Content
Mapli.ch™ structures information relating to places, institutions, businesses, services, activities, events and digital offerings in the form of listings.
A listing may contain in particular:
- name and description;
- address and geographic location;
- categories;
- opening hours;
- contact information;
- websites and social media profiles;
- images and other media provided by the relevant party;
- price information;
- booking information;
- availability information;
- reviews or editorial notes;
- thematic classifications;
- related and nearby listings.
The specific presentation depends on the applicable Listing Type, available modules and system structures defined by SwissYear.
Not every listing includes all available functions.
6. Curation and Selective Inclusion
Mapli.ch™ is not a complete or neutral mandatory database.
SwissYear may, according to its own editorial, structural, regional, qualitative and thematic criteria:
- include listings;
- reject listings;
- edit listings;
- categorise listings;
- feature listings;
- reduce visibility;
- remove listings;
- assign listings to or remove them from curated collections.
Possible criteria include in particular:
- relevance;
- quality;
- uniqueness;
- experience value;
- regional significance;
- structural suitability;
- thematic suitability;
- timeliness;
- alignment with the positioning of Mapli.ch™;
- sufficient information resources.
There is no general entitlement to inclusion, a particular ranking or permanent visibility of a listing.
Selective curation is an essential part of the platform model.
7. Visibility and Featured Listings
Mapli.ch™ may offer different visibility levels.
These may include:
- Organic Listing;
- Featured Listing;
- regional highlighting;
- category highlighting;
- prominent map placement;
- inclusion in curated collections;
- seasonal or thematic promotion;
- Sponsored Placement.
Paid visibility generally means enhanced or preferred presentation, but does not guarantee:
- a specific number of visitors;
- a specific number of leads;
- bookings;
- sales;
- search engine rankings;
- conversion rates;
- permanent placement;
- editorial recommendation.
SwissYear may adjust visibility models for technical, editorial or structural reasons.
8. Provider and User Accounts
Certain functions may require a user account.
Users are required to:
- provide accurate information;
- keep access credentials confidential;
- report unauthorised use without undue delay;
- keep their information up to date;
- not impersonate another person or misrepresent their authority.
SwissYear may suspend or terminate accounts where:
- false or misleading information is provided;
- the platform is used improperly;
- third-party rights are infringed;
- these Terms or specific conditions are breached;
- the platform or other users are placed at risk.
9. Obligations of Listing Owners and Providers
Anyone who creates, manages or provides content for a listing remains responsible for the information, content and offerings submitted by them.
The listing owner or provider undertakes to provide information to the best of their knowledge and, where applicable, to keep verified listings reasonably up to date. This includes in particular:
- keeping availability information reasonably current;
- ensuring that all required permits and licences are obtained;
- not providing misleading information;
- not infringing third-party rights;
- not publishing unlawful or impermissible offerings.
SwissYear may technically, editorially or structurally edit, supplement, correct, temporarily deactivate or remove listings and information contained therein where there is a legitimate reason to do so.
If SwissYear is notified of information that may be inaccurate, outdated, misleading, impermissible or infringing, SwissYear may give the relevant listing owner or provider a reasonable period to review and, where necessary, correct the information. Unless a shorter period is required by the circumstances, this period shall generally be 7 calendar days from notification.
If the relevant correction has not been made within this period, SwissYear may temporarily deactivate or remove the relevant listing or individual content without further notice.
SwissYear may deactivate or remove listings or content without prior notice or a correction period where this appears necessary due to the nature or seriousness of the matter, including in cases of:
- obviously unlawful content;
- serious or repeated legal violations;
- infringement of third-party rights;
- fraudulent or deliberately misleading information;
- risk to users;
- imminent damage to SwissYear, Mapli.ch™ or third parties;
- official or legal requirements.
The review or removal of a listing by SwissYear does not, in itself, constitute an admission of a legal violation or an assumption of responsibility for the relevant content.
SwissYear is not obliged to continuously review all listings or their content for accuracy, currency or legality. Any review carried out by SwissYear does not constitute a guarantee or warranty regarding the accuracy or completeness of the relevant listing.
The listing owner or provider shall indemnify SwissYear, to the extent permitted by law, against third-party claims arising from content, offerings or information provided or controlled by that listing owner or provider. This indemnity shall not apply to the extent that the relevant claim was caused by wilful misconduct or gross negligence on the part of SwissYear or where mandatory law prevents such indemnification.
10. Third-Party Providers and External Services
Mapli.ch™ may integrate or link to information, offerings, booking functions, payment functions, maps, affiliate offers or other services provided by third parties.
In such cases, a contract may arise directly between the user and the relevant third-party provider.
The contractual and privacy terms of the relevant third party may apply to such services.
SwissYear is not automatically:
- the seller;
- the service provider;
- the organiser;
- the landlord;
- the ticket provider;
- the operator of the third-party offering.
This also applies where the relevant offering is technically or visually accessible within Mapli.ch™.
11. Bookings and Individual Transactions
Mapli.ch™ may, within the intended scope of the platform, technically facilitate or broker individual services.
These may include:
- admission tickets;
- events;
- day activities;
- limited guided tours;
- restaurant reservations;
- workshops;
- individual short-term services.
Where Mapli.ch™ acts solely as an intermediary, the respective provider remains responsible for the specific service.
Additional terms and service limitations may apply to each individual booking.
12. No Package Travel and No Bundling
Mapli.ch™ does not generally sell or organise combined multi-day travel services.
In particular, the following are generally not combined into a single product within the platform model:
- accommodation;
- transport;
- activities;
- multiple travel services;
- multi-day travel components.
Combinations, routes, recommendations or thematic collections displayed through Mapli.ch™ are intended for orientation and discovery.
They do not generally constitute a single travel product sold as a package.
Unless expressly stated otherwise, each service remains independent.
Services outside the intended transaction scope may be made accessible through external providers or affiliate systems.
This contractual structure does not constitute a binding legal classification of every individual offering; mandatory statutory provisions remain reserved.
13. Curated Routes and Recommendations
Mapli.ch™ may connect listings and display, for example:
- thematic routes;
- regional recommendations;
- “What fits next” recommendations;
- Couple Activities;
- Cultural Routes;
- Scenic Exploration;
- Family-Friendly Areas;
- seasonal recommendations.
Such collections are intended as orientation and decision-making aids.
They are generally:
- not sold as a single product;
- not provided as binding travel planning;
- not a guarantee of the availability of individual offerings.
A recommendation does not constitute an assurance that a service will be available, suitable or of a quality corresponding to the user’s expectations at the desired time.
14. Prices
Unless otherwise stated, prices are shown in Swiss francs (CHF).
Additional costs, fees, taxes or third-party charges shall be disclosed in accordance with the applicable offering terms, where relevant.
Individual pricing, subscriptions, terms or payment conditions may be agreed with business customers.
15. Payment Terms
Unless otherwise agreed, invoices are payable within 30 days of the invoice date.
In the event of late payment, SwissYear may:
- temporarily suspend services;
- deactivate paid functions;
- issue payment reminders;
- charge legally permissible default interest and costs;
- terminate the contractual relationship in accordance with the applicable contractual and statutory provisions.
Different payment terms may apply to digital products, bookings or other immediate transactions.
16. Digital Products and Content
Mapli.ch™ may offer digital products and content, including:
- city guides;
- regional guides;
- thematic collections;
- curated lists;
- route content;
- digital map content;
- premium content;
- downloads.
The essential characteristics of the relevant product will be stated before purchase.
Where a digital product is made available immediately after purchase, delivery of the digital content may begin immediately after conclusion of the contract.
Mandatory statutory rights remain reserved.
17. Affiliate Links and External Redirects
Mapli.ch™ may use affiliate links or other commercial redirects to third-party providers.
Such a redirect may result in SwissYear receiving a commission without necessarily increasing the price paid by the user.
Once redirected, the terms of the respective third-party provider apply.
SwissYear is not responsible for the availability, pricing, contractual processing or performance of the third-party provider unless SwissYear is itself the contracting party for the relevant service.
18. Accuracy and Currency of Information
Mapli.ch™ seeks to provide a useful, structured and reasonably current presentation of information.
Due to the volume and nature of information and external sources, SwissYear cannot guarantee that all information is at all times:
- complete;
- current;
- error-free;
- available;
- binding;
- suitable for a particular purpose.
This applies in particular to:
- opening hours;
- prices;
- availability;
- events;
- contact details;
- weather and seasonal information;
- external offerings;
- third-party information.
For binding information, users should consult the respective service provider.
19. Maps, Geodata and Navigation
Mapli.ch™ may use mapping, geolocation and navigation services provided by third parties.
Geographic information may contain technically induced inaccuracies or deviations.
Maps, coordinates, routes and distances are generally provided for orientation and do not replace binding navigation or local verification.
For hiking, mountain activities, nature areas or other potentially safety-relevant activities, users remain responsible for appropriately assessing local conditions.
20. Recommendations and Automated Systems
Mapli.ch™ may use algorithmic or AI-assisted systems for:
- search;
- categorisation;
- recommendations;
- personalisation;
- related listing suggestions;
- thematic discovery;
- route or suggestion functions.
Such recommendations are intended as orientation aids and do not constitute a guarantee regarding the suitability or availability of an offering.
Automated suggestions do not replace professional, legal, medical, financial or safety-related advice.
21. User Content
Where provided, users may submit content such as:
- texts;
- reviews;
- images;
- videos;
- links;
- comments;
- descriptions.
Users submitting content must have the necessary rights and may not provide unlawful content or content that infringes third-party rights.
By submitting content, the user grants SwissYear the rights required for the operation, presentation, technical processing, formatting, storage and promotion of Mapli.ch™, to the extent required for the relevant platform function.
Rights in originally submitted content generally remain with the relevant rights holder unless otherwise agreed.
22. Moderation and Removal of Content
SwissYear may review content and, at its discretion, edit, decline to publish, label, reduce the visibility of or remove content, particularly where:
- it is unlawful;
- it infringes third-party rights;
- it is obviously false or misleading;
- it constitutes spam or abuse;
- it does not fit the platform structure;
- it compromises the quality or integrity of the system.
There is no entitlement to publication of submitted content.
23. Intellectual Property
Mapli.ch™, its structure and content developed by SwissYear remain, to the extent legally protected, the property of SwissYear or the respective rights holders.
This includes in particular:
- trademarks;
- names;
- logos;
- frameworks;
- categories;
- taxonomies;
- data structures;
- editorial systems;
- curated collections;
- texts;
- graphics;
- designs;
- software;
- databases;
- technical components;
- platform architecture.
Use of Mapli.ch™ does not transfer any ownership or intellectual property rights.
Systematic reproduction, extraction, processing, resale or commercial use of platform content is prohibited without appropriate authorisation.
24. Platform Structure and Data Protection
Systematic extraction or automated collection of data from Mapli.ch™ is prohibited without the express consent of SwissYear to the extent that such activity exceeds normal platform use.
This includes, without authorisation:
- automated scraping;
- systematic copying of listings;
- building competing databases;
- mass downloads;
- circumventing technical access restrictions;
- automated queries outside designated interfaces.
Mandatory statutory rights remain reserved.
25. Availability and Technical Changes
SwissYear seeks to provide reliable availability of Mapli.ch™, but does not guarantee uninterrupted or error-free availability.
Temporary restrictions may arise in particular from:
- maintenance;
- technical disruptions;
- security measures;
- updates;
- external infrastructure;
- third parties;
- force majeure.
SwissYear may further develop the platform technically and functionally.
This may include changes to:
- categories;
- Listing Types;
- modules;
- features;
- search functions;
- maps;
- visibility models;
- user interfaces.
26. Responsibility for Third-Party Providers
Where a service is provided exclusively by a third party, that third party is responsible for its own service.
SwissYear is not responsible for:
- third-party service failures;
- incorrect information supplied by a third party;
- its pricing;
- its availability;
- its cancellation terms;
- its performance;
- its conduct towards users,
to the extent that SwissYear does not itself owe the relevant service contractually.
Mandatory statutory liability provisions remain reserved.
27. Liability
SwissYear shall be liable within the scope of mandatory statutory provisions.
To the extent permitted by law, SwissYear shall not be liable for indirect damages or consequential losses, lost profits, lost business opportunities or losses arising exclusively from decisions made by users or from services provided by third parties.
SwissYear shall in particular not be liable for the actual quality, safety, suitability or availability of a third-party offering where SwissYear is not itself the provider of that service.
Any limitation of liability shall not apply where mandatory Swiss law provides otherwise, including in cases of wilful misconduct or gross negligence.
28. User Responsibility
Use of discovery, map, recommendation and information functions is generally at the user’s own responsibility.
Before making an actual booking, journey, activity or use of a service, users should independently verify:
- current availability;
- prices;
- opening hours;
- requirements;
- safety conditions;
- access requirements;
- weather and seasonal conditions;
- suitability for their individual circumstances.
Mapli.ch™ facilitates decisions and discovery but does not generally assume responsibility for the entirety of a user’s journey or individual undertaking.
29. Data Protection
SwissYear processes personal data in connection with Mapli.ch™ in accordance with applicable data protection law, in particular the Swiss Federal Act on Data Protection (FADP/DSG) and the applicable Data Protection Ordinance (DPO/DSV), where applicable.
Details regarding the processing of personal data, including:
- data collected;
- processing purposes;
- cookies and tracking;
- third parties;
- maps and analytics services;
- international data transfers;
- retention periods;
- data subject rights
are governed by a separate Mapli.ch™ Privacy Policy.
The Privacy Policy forms part of the legal framework of the platform to the extent applicable to the relevant use.
30. Term and Termination for Providers
For ongoing paid listing, visibility, subscription or B2B services, the agreed term and termination periods shall apply.
Where no fixed term or special notice period has been agreed, an ongoing agreement may generally be terminated in writing with 30 days’ notice to the end of a calendar month.
The right to terminate for good cause without notice remains reserved.
Services already provided and fees accrued up to termination remain payable unless otherwise agreed.
31. Suspension and Termination
SwissYear may temporarily suspend or permanently deactivate user accounts, listings or paid functions where there is a legitimate reason.
Such a reason may include:
- breach of contract;
- legal violations;
- abuse;
- fraudulent conduct;
- repeated false information;
- risk to the platform;
- outstanding payments;
- infringement of third-party rights.
Mandatory statutory rights remain reserved.
32. Confidentiality
Non-public business or project information received by SwissYear or business partners in the course of a cooperation shall be treated confidentially.
This obligation does not apply to information that:
- is already publicly known;
- becomes public without breach of a confidentiality obligation;
- was lawfully received from third parties;
- must be disclosed by law.
Separate confidentiality agreements may be concluded for specific business relationships.
33. Relationship to the SwissYear Framework
Mapli.ch™ forms part of the SwissYear ecosystem and is operated within SwissYear Plus™.
These Terms specify the use of and services provided through Mapli.ch™.
For overarching SwissYear services, the general SwissYear Framework Terms or separate contractual terms may additionally apply.
In the event of a conflict, the more specific Mapli.ch™ provision shall generally prevail for Mapli.ch™-specific services.
For individually agreed services, the applicable individual contractual terms shall take precedence.
34. Amendments to These Terms
SwissYear may amend these Terms where this is required or appropriate due to:
- technical developments;
- new functions;
- changes to the business model;
- legal or regulatory requirements;
- changes to third-party services.
The version published at the relevant time shall apply to new contractual relationships.
For ongoing contractual relationships, material changes shall be communicated in an appropriate manner where required.
Where a user does not agree to a change and a right of termination exists, the contractual relationship may be terminated in accordance with the applicable terms.
35. Severability
If any provision of these Terms is or becomes wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
The invalid or unenforceable provision shall be replaced by a valid provision that comes as close as reasonably possible to the economic purpose of the original provision.
36. Governing Law
Swiss law shall apply, excluding conflict-of-law rules that would result in the application of another legal system.
Mandatory statutory protection provisions applicable to particular users remain reserved.
37. Place of Jurisdiction
To the extent permitted by law, the place of jurisdiction for disputes arising from or in connection with these Terms shall be Basel-Stadt, Switzerland.
Mandatory statutory places of jurisdiction remain reserved, including those that may apply to consumers.
